Terms of Service

These Terms of Service (“Terms”) set forth the conditions for the use of the Hakimono Sekizuka Iwakura AA Online Store (the “Service”) provided on this website by Hakimono Sekizuka (“Company,” “we,” “us,” or “our”). Registered users (“Users”) shall use the Service in accordance with these Terms.


Article 1 (Scope of Application)

  1. Registration shall be completed when an applicant agrees to these Terms, applies for registration in the manner specified by the Company, and receives approval from the Company.

  2. The Company may refuse registration if it determines that the applicant falls under any of the following, and shall have no obligation to disclose the reason:

    1. False information was provided in the registration application.

    2. The applicant has previously violated these Terms.

    3. The Company otherwise deems the registration inappropriate.


Article 3 (Management of User ID and Password)

  1. Users shall manage their User ID and password at their own responsibility.

  2. Users may not transfer, lend, or share their User ID and password with any third party. The Company shall deem any login using matching registration information to be made by the registered User.

  3. The Company shall not be liable for damages resulting from unauthorized use of a User ID or password, except in cases of willful misconduct or gross negligence by the Company.


Article 4 (Sales Contract)

  1. A sales contract shall be concluded when a User places an order and the Company notifies the User of its acceptance. Ownership of the product shall transfer to the User upon delivery of the product to the shipping carrier.

  2. The Company may cancel the sales contract without prior notice if:

    1. The User violates these Terms.

    2. Delivery cannot be completed due to unknown address or prolonged absence.

    3. The Company determines that the relationship of trust between the User and the Company has been impaired.

  3. Payment methods, shipping methods, order cancellations, and returns shall be governed separately by the Company’s policies.


Article 5 (Intellectual Property Rights)

All copyrights and other intellectual property rights related to product images and other content provided through the Service belong to the Company or legitimate rights holders. Users may not reproduce, reprint, modify, or otherwise use such content without authorization.


Article 6 (Prohibited Conduct)

Users shall not engage in the following:

  1. Acts that violate laws or public order and morals

  2. Acts related to criminal activity

  3. Infringement of intellectual property rights contained in the Service

  4. Interference with the Company’s servers or network functions

  5. Commercial use of information obtained through the Service

  6. Acts that disrupt the operation of the Service

  7. Unauthorized access or attempts thereof

  8. Collection or accumulation of other Users’ personal information

  9. Impersonation of another User

  10. Providing benefits to anti-social forces in connection with the Service

  11. Any other acts deemed inappropriate by the Company


Article 7 (Suspension of the Service)

  1. The Company may suspend or interrupt all or part of the Service without prior notice if:

    1. System maintenance or updates are required

    2. Provision becomes difficult due to force majeure (earthquake, lightning, fire, power outage, natural disasters, etc.)

    3. Computer or communication lines are disrupted by accident

    4. The Company otherwise determines that provision is difficult

  2. The Company shall not be liable for any disadvantage or damage incurred by Users or third parties due to suspension or interruption.


Article 8 (Restriction of Use and Deregistration)

  1. The Company may restrict use of the Service or cancel registration without prior notice if:

    1. The User violates these Terms

    2. False information is discovered in registration details

    3. The User’s registered credit card is suspended

    4. Payment obligations are not fulfilled

    5. The User fails to respond to Company communications for a certain period

    6. The Service has not been used for a certain period

    7. The Company otherwise deems use inappropriate

  2. The Company shall not be liable for damages arising from actions taken under this Article.


Article 9 (Withdrawal)

Users may withdraw from the Service by completing the prescribed procedure.


Article 10 (Disclaimer and Limitation of Liability)

  1. The Company does not guarantee that the Service is free from factual or legal defects (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security defects, errors, bugs, or infringement of rights).

  2. The Company shall not be liable for any damages arising from the Service. However, if the contract between the Company and the User constitutes a consumer contract under Japanese law, this disclaimer shall not apply. Even in such cases, the Company shall not be liable for special damages arising from circumstances that were foreseeable or could have been foreseen, except in cases of willful misconduct or gross negligence.

  3. The Company shall not be responsible for any transactions, communications, or disputes between Users and third parties in connection with the Service.


Article 11 (Changes or Termination of the Service)

The Company may change or discontinue the Service without prior notice and shall not be liable for resulting damages.


Article 12 (Amendment of Terms)

The Company may amend these Terms at any time without prior notice. Continued use of the Service after amendments constitutes acceptance of the revised Terms.


Article 13 (Handling of Personal Information)

Personal information obtained through use of the Service shall be handled appropriately in accordance with the Company’s Privacy Policy.


Article 14 (Notices and Communications)

Notices between Users and the Company shall be made by the method specified by the Company. Unless a User submits a change notification in the prescribed manner, the Company shall deem the registered contact information valid and any notice sent thereto shall be deemed received at the time of dispatch.


Article 15 (Prohibition of Assignment)

Users may not assign or transfer their contractual status, rights, or obligations under these Terms without prior written consent from the Company.


Article 16 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company’s location.
